    • "User Content" means images, text, descriptions, or data you upload or provide to the Service
    • "Intellectual Property" means patents, trademarks, copyrights, trade secrets, and other IP rights
    • "Service" means the website, mobile applications, and AI generation services provided by Glamore.ai
    • "Third-Party Services" means services provided by entities other than Glamore.ai
    • "Billing Period" means the period for which subscription fees are charged (monthly, yearly, or custom)
    • "Fees" means subscription charges, usage charges, and other payments for the Service

    3. Service Description and Scope

    3.1 Service Overview

    Glamore.ai provides an AI-powered service that allows users to:

    • Upload product images
    • Provide styling directions and prompts
    • Generate high-quality AI-styled images and videos
    • Download generated outputs for personal and commercial use
    • Manage accounts and billing

    3.2 Service Availability

    • The Service is provided on an "as-is" and "as-available" basis
    • We do not guarantee continuous, uninterrupted access
    • We may perform maintenance, updates, or improvements with or without notice
    • Emergency maintenance may be performed without advance notice

    3.3 Geographic Availability

    The Service is available to users worldwide, subject to:

    • Applicable local laws and regulations
    • Export control regulations
    • Sanctions and restrictions on certain jurisdictions

    Restricted Access:

    We may restrict access from certain countries due to legal requirements or business decisions.

    3.4 Device and Network Requirements

    You are responsible for providing:

    • Appropriate computer/device equipment
    • Internet connectivity
    • Compatible web browser (current version of Chrome, Firefox, Safari, or Edge)
    • Minimum internet speed (recommended 5 Mbps)

    4. Account Registration and Eligibility

    4.1 Eligibility Requirements

    By using the Service, you represent and warrant that you:

    • Are at least 18 years of age (or legal age of majority in your jurisdiction)
    • Have the legal capacity to enter into a binding agreement
    • Are not a minor or under guardianship
    • Are not in a country subject to US government embargo
    • Are not listed on any government sanctions lists
    • Have authority to bind any organization you represent

    Children:

    The Service is not directed to individuals under 18. If you are under 18, please do not use this Service.

    4.2 Account Registration

    To create an account, you must:

    • Provide accurate, current, and complete information
    • Create a unique username and password
    • Select a secure password (minimum 8 characters, mixed case, numbers, symbols)
    • Maintain the confidentiality of your password
    • Accept these Terms and Privacy Policy

    4.3 Account Security

    Your Responsibilities:

    • Do not share your login credentials with others
    • Do not access another user's account without permission
    • Notify us immediately of unauthorized access or suspected breach
    • Log out when using shared devices
    • Monitor account activity for unauthorized access

    Account Suspension:

    • You disclose credentials to unauthorized persons
    • We detect unauthorized access
    • Multiple failed login attempts occur
    • You violate security practices

    4.4 Account Information Accuracy

    You must:

    • Keep account information current and accurate
    • Update profile information through account settings
    • Notify us of changes to email address or billing information
    • Be responsible for all activity occurring under your account

    5. Service Ordering and Acceptance

    5.1 Order Process

    To Order Services:

    1. Choose a pricing plan or custom service option
    2. Fill out the order form with required information
    3. Review and accept these Terms and Privacy Policy
    4. Submit the order through the Website
    5. Complete payment
    6. Receive order confirmation via email

    5.2 Order Acceptance

    Binding Agreement:

    • The order does not form a binding agreement until we provide acceptance
    • Acceptance occurs by:
      • Sending a confirmation email
      • Providing access to the Service
      • Issuing an invoice
      • Charge appearing on your payment method

    Right to Refuse Orders:

    • Users with previous Terms violations
    • Users with outstanding payment issues
    • Users associated with fraud or abuse
    • Orders from restricted jurisdictions

    5.3 No Client Terms Override

    These Terms constitute the entire agreement between you and Glamore.ai. Any terms, conditions, or agreements you propose will not:

    • Supersede these Terms
    • Supplement these Terms
    • Modify these Terms

    Acceptance of these Terms is a condition of using the Service.

    6. Pricing, Fees, and Payment

    6.1 Pricing Structure

    6.2 Payment Methods

    Accepted Payment Methods:

    • Credit/Debit cards (Visa, Mastercard, American Express)
    • Digital wallets (Apple Pay, Google Pay)
    • Net banking (Indian bank transfers)
    • UPI (Unified Payments Interface)
    • Bank transfers for bulk orders
    • Cryptocurrency (where permitted)

    Payment Processors:

    • Stripe
    • Razorpay
    • PayU
    • Other PCI-DSS compliant processors

    6.3 Billing and Invoicing

    Billing Process:

    • Invoices are issued after successful payment
    • Invoices include itemized services, dates, and pricing
    • Electronic invoices sent to registered email
    • Paper invoices available upon request (with delivery fees)

    Billing Records:

    • Invoices retained for 7 years (legal/tax compliance)
    • You can download invoices from account settings
    • Missing invoices can be requested via support

    6.4 Subscription and Recurring Charges

    Subscriptions (if applicable):

    • Subscription Fees are charged automatically every billing period
    • Fees continue until you cancel or the Agreement terminates
    • Automatic renewal occurs unless you opt-out

    Auto-Renewal Management:

    • Cancel auto-renewal in account settings anytime
    • Cancellation does not refund current billing period
    • Termination takes effect on the last day of current Billing Period
    • You retain access until the period ends

    Failed Payments:

    • If payment fails, we will attempt to recharge within 5 business days
    • Multiple failed attempts may result in service suspension
    • Suspended accounts reactivate upon successful payment
    • Charges may accrue during suspension

    6.5 Price Changes

    Price Adjustment Rights:

    • We may change prices at any time with 30 days' notice
    • Current customers continue at existing rates for current Billing Period
    • New rates apply at renewal for continuing customers
    • You can cancel before price increase becomes effective
    • Continued use after notification constitutes acceptance

    6.6 No Refunds - Non-Refundable Policy

    All payments are non-refundable except where required by law.

    No Refunds For:

    • Service used (even if partially used)
    • Downloaded AI Outputs
    • Unused subscription time
    • Cancelled orders
    • Failed generations (unless due to our error)
    • Change of mind
    • Satisfaction with quality (within reasonable standards)

    Exceptions (Refundable):

    • Service failure/downtime exceeding 24 hours
    • Duplicate charges/billing errors
    • Unauthorized charges
    • Forced refunds by payment processors
    • Legal requirements in certain jurisdictions

    Refund Process:

    • Request within 30 days of charge
    • Provide clear explanation
    • Submit through support or email
    • Processed within 10-15 business days
    • Refund to original payment method

    6.7 Taxes and Additional Charges

    Taxes:

    • All prices are exclusive of taxes unless specified
    • Applicable GST (Goods and Services Tax) added at checkout
    • International users: VAT/Sales Tax calculated and added
    • Responsibility for calculation and payment of taxes

    Additional Charges:

    • Currency conversion fees apply for international payments
    • Payment processing fees may apply (disclosed at checkout)
    • Rush delivery charges for expedited services
    • Custom service fees negotiated separately

    6.8 Currency and Exchange Rates

    • Primary currency: Indian Rupees (₹)
    • International customers charged in their local currency
    • Exchange rates: Based on payment processor rates at time of transaction
    • No guarantee of stable rates

    7. Service Usage Rights and Restrictions

    7.1 Limited License Grant

    Subject to your compliance with these Terms, we grant you a revocable, non-exclusive, non-transferable, non-assignable license to:

    • Access and use the Service for authorized purposes
    • Generate AI Outputs for personal and commercial use
    • Download and distribute AI Outputs
    • Store AI Outputs on your devices

    License Limitations:

    • License is personal to you
    • You cannot sublicense to others
    • License terminates upon account termination
    • No ownership transfer of the Service itself

    7.2 Permitted Uses

    • Generate images for your business/brand use
    • Use AI Outputs in marketing materials, websites, social media
    • Sell products featuring AI Outputs
    • Modify AI Outputs (crop, resize, edit)
    • Create derivative works from AI Outputs
    • Use for commercial purposes
    • Transfer AI Outputs to other parties

    7.3 Prohibited Uses

    Content and Intellectual Property:

    • Violate third-party copyrights or intellectual property rights
    • Infringe on celebrity likenesses or public figures (without consent)
    • Create outputs containing trademarked logos or brands (without permission)
    • Generate content violating third-party trade dress
    • Claim you created the images (must disclose AI generation)

    Harmful Content:

    • Create hateful, discriminatory, or violent content
    • Generate content promoting illegal activities
    • Create non-consensual intimate imagery
    • Generate content mocking or defaming individuals
    • Create deepfakes intended to deceive
    • Generate content promoting self-harm or suicide

    Misuse and Abuse:

    • Exploit or harm the Service infrastructure
    • Perform unauthorized access or hacking attempts
    • Create bots or automated access without permission
    • Interfere with other users' service access
    • Reverse-engineer or decompile the Service
    • Create competing services using our technology

    Fraud and Deception:

    • Use false identity or impersonate others
    • Make false claims about AI Outputs quality
    • Engage in fraudulent transactions
    • Use the Service for money laundering or illegal activities
    • Violate sanctions or export controls

    7.4 User Content Responsibility

    You are solely responsible for:

    • All User Content you upload
    • Ensuring User Content doesn't violate third-party rights
    • Ensuring User Content compliance with applicable laws
    • Accuracy and authenticity of information provided
    • Obtaining necessary rights to use source images
    • Compliance with Model Releases and Property Rights (if applicable)

    Indemnification:

    You indemnify Glamore.ai against claims arising from your User Content or use violations.

    7.5 Content Moderation and Removal

    We may remove or restrict:

    • Content violating these Terms
    • Content that is illegal
    • Content that infringes on rights
    • Content violating applicable laws
    • Spam or abusive content

    Removal Process:

    • Content removed without advance notice if urgent
    • User notification within 24 hours
    • Opportunity to appeal within 30 days
    • Explanation of violation provided
    • Repeated violations result in account termination

    7.6 Uploading Images and Model/Property Releases

    Your Representations:

    • You own or have rights to upload images
    • You have obtained necessary permissions:
      • Model Releases: If images contain identifiable people
      • Property Releases: If images contain private property
      • Commercial Clearance: For use in commercial context
    • You have disclosed any licensing restrictions
    • No images contain confidential or proprietary information

    Glamore.ai's Role:

    • We do not verify rights to uploaded images
    • You are solely responsible for ensuring compliance
    • We cannot guarantee immunity from infringement claims
    • We may require proof of rights upon request

    8. AI Outputs and Intellectual Property

    8.1 Ownership of AI Outputs

    You Own:

    • All rights to AI Outputs generated through the Service
    • Copyright and ownership of generated images/videos
    • Right to use outputs commercially
    • Right to modify, adapt, or create derivatives
    • Right to sell, distribute, license, or sublicense

    You Can:

    • Use outputs in advertising and marketing
    • Sell products featuring outputs
    • Distribute outputs to customers
    • License outputs to third parties
    • Use for any commercial or personal purpose
    • Create variations or remixes

    8.2 Commercial Rights

    Full Commercial Use Granted:

    • No additional licensing required
    • No attribution or credit required
    • No royalties or compensation due to Glamore.ai
    • Unrestricted commercial exploitation
    • Usage in competitive products permitted

    Specific Commercial Rights:

    • Print on merchandise (t-shirts, posters, etc.)
    • Use in email marketing campaigns
    • Feature in social media advertising
    • Incorporate in website designs
    • Use in product catalogs and e-commerce
    • Package as digital products for resale

    8.3 Limitations on Your Rights

    • Do not claim you photographed/created the images
    • Do not misrepresent the nature of the images
    • Do not use to violate third-party rights
    • Do not violate underlying source image rights
    • Do not create competing AI generation services using outputs
    • Do not systematically collect outputs to build competing databases

    8.4 Glamore.ai's Retained Rights

    • Right to use outputs for marketing/testimonials (with permission)
    • Right to use in case studies or portfolios
    • Right to aggregate analytics about outputs
    • Right to improve algorithms using anonymized data
    • Right to feature outputs in galleries (with opt-out option)
    • Intellectual property rights to the Service itself

    8.5 AI Model and Technology Ownership

    Glamore.ai Owns:

    • AI models and algorithms
    • Service infrastructure
    • Website and mobile apps
    • Trademarks and branding
    • Source code and technical systems
    • Training data and model weights

    You Cannot:

    • Access underlying AI models
    • Reverse-engineer models or systems
    • Attempt to extract training data
    • Create competing services from our technology
    • Claim ownership of our technology

    9. Warranties and Disclaimers

    9.1 Limited Warranty

    We warrant that:

    • Service will be provided in a professional manner
    • Core functionality will be maintained as described
    • Service will generally be available (with planned downtime)
    • We will use commercially reasonable efforts to prevent errors

    9.2 Disclaimer of Warranties

    EXCEPT AS EXPRESSLY PROVIDED IN SECTION 9.1, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY.

    Specifically, we disclaim:

    • Implied warranties of merchantability
    • Implied warranties of fitness for a particular purpose
    • Implied warranties of satisfactory quality
    • Implied warranties of non-infringement
    • Warranties of availability or uptime
    • Warranties regarding output quality
    • Warranties regarding algorithm accuracy
    • Warranties that errors will be corrected

    You Acknowledge:

    • The Service may contain errors, bugs, or defects
    • Output quality depends on input quality
    • AI may generate unexpected or unsuitable results
    • Service may be interrupted or discontinued
    • We are not responsible for data loss

    9.3 No Guarantee of Specific Outcomes

    • AI Outputs will meet your exact specifications
    • Outputs will increase sales or conversions
    • Outputs will be production-ready without editing
    • Multiple generations from same input will be identical
    • Service will be error-free
    • Accuracy of AI models or algorithms

    9.4 Assumption of Risk

    • You are responsible for evaluating output quality
    • You bear the risk of relying on AI-generated content
    • You assume responsibility for consequences of use
    • You bear risk of infringement of third-party rights
    • You assume data security risks

    10. Limitation of Liability

    10.1 Limitations on Liability

    To the maximum extent permitted by law, Glamore.ai shall not be liable for:

    Direct Damages:

    • Direct damages from Service use or inability to use
    • Damages from reliance on Service outputs
    • Business losses from Service unavailability
    • Costs to replace the Service

    Indirect Damages:

    • Lost profits or business opportunity
    • Lost revenue or income
    • Lost data or information
    • Lost customers or contracts
    • Lost goodwill or reputation
    • Business interruption
    • Consequential damages
    • Incidental damages
    • Punitive or exemplary damages
    • Damages for emotional distress

    10.2 Liability Cap

    Our total cumulative liability for all claims arising from these Terms or the Service shall not exceed:

    • The total fees paid by you in the 12 months preceding the claim, OR
    • ₹10,000 (whichever is greater)

    This cap applies to all claims, causes of action, and allegations, whether based on warranty, contract, tort, or statute, regardless of notice of possibility of damages.

    10.3 Exceptions to Limitations

    Liability Limitations Do Not Apply To:

    • Gross negligence or willful misconduct of Glamore.ai
    • Fraudulent misrepresentation
    • Death or personal injury caused by our negligence
    • Data breaches due to our failure to implement reasonable security
    • Breaches required to be non-excludable by law

    Certain jurisdictions may not permit liability limitations, making them unenforceable. Applicable law will determine liability in such cases.

    10.4 Essential Provision

    You acknowledge that these limitations are an essential basis for the pricing and provision of the Service. Without these limitations, we could not provide the Service at current prices.

    11. Indemnification

    11.1 Your Indemnification Obligations

    You agree to indemnify, defend, and hold harmless Glamore.ai and its officers, directors, employees, agents, and successors from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from or related to:

    Your Conduct:

    • Violation of these Terms
    • Violation of applicable laws
    • Use of the Service violating third-party rights
    • Infringement of copyrights, trademarks, or patents
    • Unauthorized use of intellectual property
    • Defamatory or harmful content you create

    Your User Content:

    • Claims related to User Content you upload
    • Infringement claims based on source images
    • Model release or property release violations
    • Rights violations in User Content
    • Privacy violations from User Content

    Your Usage:

    • Damages from your use of AI Outputs
    • Claims you misrepresented AI Outputs
    • Claims from your commercial use

    11.2 Indemnification Procedures

    When we seek indemnification:

    1. We provide prompt written notice of the claim
    2. You assume control of defense and settlement
    3. We cooperate and provide information
    4. You consult us before settling
    5. You pay all defense costs and damages

    12. Confidentiality

    12.1 Confidential Information

    Confidential Information is non-public information disclosed by one party to the other, including:

    • Business methods and strategies
    • Pricing and financial information
    • Technical specifications
    • User data and account information
    • Trade secrets and proprietary data

    Exclusions:

    • Public domain information
    • Known before disclosure
    • Independently developed
    • Rightfully obtained from third parties
    • Legally required to disclose

    12.2 Obligations

    You must:

    • Keep our Confidential Information confidential
    • Use only for purposes authorized
    • Not disclose to third parties without consent
    • Implement reasonable security measures
    • Limit access to need-to-know personnel

    We must:

    • Keep your Confidential Information confidential
    • Use only for service provision
    • Not disclose unless legally required
    • Protect with reasonable security

    12.3 Legal Disclosure

    Either party may disclose Confidential Information if:

    • Legally required by court order, subpoena, or government request
    • Required by securities laws or regulations
    • Disclosed to comply with legal obligations

    Notification:

    • Notify other party of legal requirement before disclosure
    • Cooperate to seek protective orders
    • Disclose only minimally required information

    13. Service Modifications and Discontinuation

    13.1 Right to Modify Service

    We may:

    • Add, remove, or modify features
    • Change functionality or user interface
    • Implement new policies or requirements
    • Discontinue or suspend services
    • Change pricing (with notice)

    Notice:

    • Material changes: 30 days' notice
    • Urgent changes (security): Immediate notice

    13.2 Maintenance and Downtime

    Planned Maintenance:

    • We schedule maintenance during off-peak hours
    • Advance notice provided when possible
    • Typical duration: 2-4 hours monthly

    Emergency Maintenance:

    • Performed without advance notice if urgent
    • Notification provided as soon as possible
    • Duration varies based on issue

    Service Availability:

    • We target 99% uptime for paid services
    • "Uptime" excludes planned maintenance
    • Does not include force majeure events

    13.3 Discontinuation of Service

    We may discontinue the Service or features:

    • With 90 days' notice to users
    • Immediately if legally required
    • Immediately for security reasons
    • Upon Agreement termination

    Upon Discontinuation:

    • Access to Service terminates
    • You lose ability to generate new outputs
    • You retain access to previously generated outputs
    • Refund provided for unused subscription time (unused portion)

    14. Termination and Account Closure

    14.1 Termination by You (User)

    Cancellation of Subscription:

    • Cancel anytime through account settings
    • No penalty or cancellation fees
    • Termination effective at end of current Billing Period
    • Access continues until period end
    • No refund of current period

    Account Closure:

    • Request deletion through support
    • Provide written notice
    • Account deleted within 30 days
    • User Content deleted (unless exempted by law)
    • Cannot restore deleted account

    14.2 Termination by Glamore.ai

    Termination Without Cause:

    • At any time for any reason
    • With 30 days' notice for convenience
    • Refund of unused subscription time

    Termination For Cause:

    • Terms Violations: Violating provisions of Terms, privacy policies, unauthorized access, abusive or harassing conduct
    • Illegal Activity: Using Service for illegal purposes, fraud, money laundering, sanctions/export control violations
    • Harmful Content: Generating hateful/violent content, non-consensual intimate imagery, defamatory content, third-party rights violations
    • Technical Abuse: Hacking, bots/automation abuse, DDoS or attacks, reverse-engineering attempts
    • Payment Issues: Non-payment, chargebacks, excessive failed transactions

    14.3 Effects of Termination

    Upon Termination:

    • All rights to use Service immediately cease
    • Access to Account terminated
    • Inability to generate new outputs
    • Inability to download from Service (after 30 days)
    • Cancellation of subscription
    • No refund of paid amounts (except unused time)
    • Your User Content deleted (upon request or per retention policy)

    Survival:

    • Sections: 7.4, 8, 9, 10, 11, 12, 14, 15, 16, 17
    • Your indemnification obligations
    • Liability limitations
    • Confidentiality provisions

    14.4 Right to Appeal

    • You have 30 days to appeal if your account is terminated for suspected violation
    • Submit appeal through support@glamore.ai
    • Provide explanation and evidence
    • We review within 10 business days
    • Decision is final

    15. Dispute Resolution and Governing Law

    15.1 Informal Resolution

    • Contact us at support@glamore.ai
    • Describe the dispute in detail
    • Provide relevant documentation
    • Allow 30 days for us to respond
    • Negotiate in good faith

    15.2 Governing Law

    • Laws of India (primary jurisdiction)
    • Applicable laws of your jurisdiction (supplementary)
    • Principles of conflict of law
    • Excluded: UN Convention on Contracts for International Sale of Goods

    15.3 Jurisdiction and Venue

    • Indian courts for residents of India
    • Federal and state courts of user's jurisdiction for international users
    • Parties waive right to jury trial

    15.4 Arbitration (Alternative)

    • Either party may elect arbitration for disputes over ₹10 Lakhs
    • Administered under Indian Arbitration and Conciliation Act, 1996
    • Single arbitrator for claims under ₹50 Lakhs
    • Three arbitrators for larger claims
    • Arbitration in Delhi, India
    • Costs split between parties unless award specifies otherwise

    15.5 Limitations Period

    • All claims must be brought within 2 years of the claim arising
    • Claims after 2 years are barred
    • Continuing violations reset the period

    15.6 Equitable Relief

    • Breach of these Terms may cause irreparable harm
    • Monetary damages may be inadequate remedy
    • Glamore.ai may seek injunctive relief
    • Glamore.ai may pursue equitable remedies
    • These remedies are in addition to other remedies

    16. General Provisions

    16.1 Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Glamore.ai regarding the Service. Previous agreements, understandings, and negotiations are superseded.

    16.2 Severability

    • If any provision is found invalid or unenforceable, it is modified to the minimum extent necessary.
    • Remaining provisions remain in full effect.
    • If modification impossible, provision is severed.
    • Agreement continues with remaining terms.

    16.3 Waiver

    • Failure to enforce any provision is not a waiver.
    • Waiver of one provision is not waiver of others.
    • Waiver must be in writing and signed.
    • Waiver is effective only for the specific circumstance.

    16.4 No Third-Party Beneficiaries

    These Terms are for you and Glamore.ai only. No third party has any rights or claims except as explicitly stated.

    16.5 Assignment

    You Cannot:

    • Assign these Terms or rights/obligations
    • Transfer your account to others
    • Sublicense access to others

    We Can:

    • Assign Terms to successors or acquirers
    • Assign to affiliates or business partners

    Glamore.ai is not liable for failure to perform if caused by:

    • Severe weather conditions
    • Internet backbone failures
    • Government actions or regulations
    • Utility failures (power, telecommunications)

    Exclusions: Payment obligations are not excused; must notify you of force majeure event; must resume performance when possible.

    16.8 Severability

    If any portion is invalid, the invalid portion is modified minimally to be valid, and remaining Terms remain fully enforceable. The spirit and intent of the Agreement is preserved.
